HIPAA penalties 2026 update: civil fines up to $2,190,294, no inflation adjustment this year, OCR enforcement priorities

1 fonte(s) · 1 atualização(ões) · publicado 22/10/2026 01:15 · coletado há 2 horas

The HIPAA Journal explainer sets out the HIPAA violation penalty framework in 2026. Civil monetary penalties range from $145 to $2,190,294 per violation, depending on culpability. Criminal penalties and state attorney general actions can apply as well. HHS confirmed in October 2026 that there will be no inflation adjustment in 2026, because the fall 2025 government shutdown prevented the BLS from producing the data needed for an OMB multiplier. The 2025 rates therefore stay in force until the 2027 adjustment. OCR says its Right of Access and risk analysis enforcement initiatives continue in 2026, and the risk analysis initiative will expand to cover risk management.

Detalhes técnicos

  • Civil penalty tiers: Tier 1 (unaware, could not have avoided), Tier 2 (should have known), Tier 3 (willful neglect, corrected) and Tier 4 (willful neglect, not corrected within 30 days). Under the 2019 Notice of Enforcement Discretion, OCR applies a separate annual cap to each tier. The $1.5 million cap, which is $2,190,294 in 2026, applies only to Tier 4.
  • OCR penalty factors: duration of the violation, number of people affected, nature of the data exposed, recognized security practices in place for the prior 12 months, cooperation with the investigation, prior history, financial condition and harm caused.
  • State attorneys general: they can seek up to $25,000 per violation category per year under the HITECH Act. Multi-state actions are common after large breaches such as those at Blackbaud and Inmediata.
  • Criminal penalties (prosecuted by DOJ): up to 1 year for reasonable cause or no knowledge, up to 5 years for obtaining PHI under false pretenses, and up to 10 years for obtaining PHI for personal gain or with malicious intent.
  • Enforcement trend: OCR closed 22 actions in 2024 and ended 2025 with 21 settlements and civil monetary penalties, the second-highest annual total. Fines are relatively small because the risk analysis initiative targets a single provision. Risk analysis failure is the most commonly identified Security Rule violation. OCR also now enforces the Part 2 regulations on substance use disorder records.

Remediação

  • Conduct and document an organization-wide risk analysis, and show that identified risks are managed down to a low and acceptable level.
  • Keep breach notifications within the 60-day limit.
  • Apply the minimum necessary standard.
  • Train staff on HIPAA civil and criminal liability.
  • Put access controls and audit mechanisms in place to detect improper access to PHI.
